Complex Civil Litigation involving Technical, Scientific and Daubert Issues
In 2002, Mr. Withers successfully settled a wrongful death civil case for $2,000,000, which was filed in United States District Court for the Southern District of Georgia.
Gillen, Withers & Lake, LLC was on the cutting edge of the subprime mortgage crisis, when, along with other experienced class action counsel, they filed a lawsuit against Novastar Home Mortgage, Inc., in federal court. That case was ultimately resolved by a settlement that was valued in court at more than $17 million.
Many civil cases involve complex, technical or scientific issues. Our firm is experienced in handling these issues, including making and preparing to meet challenges pursuant to Daubert v. Merrell Dow Pharmaceuticals, 509 U.S. 579 (1993). In Georgia D.O.T. v. D.A., Inc. (Turner & Fulton Counties 2006), Mr. Gillen successfully challenged testing by the State pursuant to Daubert on behalf of a corporate client, which resulted in success.
