Fellow of the American College of Trial Lawyers. Former Assistant United States Attorney and Chief of the Criminal Section, Southern District of Georgia (1990–1998). Tom Withers has spent his career in federal courtrooms — first building the government’s most complex cases, then taking them apart.
As a federal prosecutor, he served as lead counsel in major prosecutions including a nationally covered Medicare fraud scheme. He supervised all criminal matters in the district and developed deep experience in multi-defendant cases, financial crimes, healthcare fraud, and public corruption.
In private practice, Mr. Withers has represented corporations, executives, public officials, judges, and attorneys facing serious federal and state charges. Results include dismissed indictments in cases carrying life imprisonment, not guilty verdicts in fraud and drug conspiracy trials, acquittals on all counts in cases with mandatory minimums, and favorable plea agreements in complex matters. In federal court, results include a 6-month sentence in place of a mandatory 20- year minimum after the conspiracy indictment was dismissed. In Georgia state courts, results include not guilty verdicts after jury trials on charges carrying mandatory minimums of 25 years, dismissed indictments after years under prosecution, and acquittals that preserved clients’ careers and reputations. He also served as liaison counsel in the Pitts v. Novastar class action ($17M+ settlement), and in class actions against Home Depot and Equifax. His appellate work includes a successful First Step Act appeal securing a federal inmate’s release. Prior results do not guarantee a similar outcome.
