Government Investigations & Defense of Public Officials

A government investigation can upend your life before any charges are filed. The decisions made in the earliest stages often determine whether charges are ever brought. Tom Withers spent eight years inside the federal prosecution system and knows how investigations are built, when prosecution is likely, and when there is an opportunity to resolve a matter before indictment.

Criminal, Grand Jury, Administrative & Legislative Investigations

Mr. Withers frequently represents subjects and targets of federal and state grand jury investigations. His approach draws directly on his experience as a former federal prosecutor, giving him a practical understanding of how the government builds its cases.

The firm’s goal in investigation matters is to protect the client’s rights, limit exposure, and whenever possible, resolve the matter before charges are filed. In U.S. v. M.O., the government dismissed the indictment with prejudice on the eve of trial in a case carrying life imprisonment. In U.S. v. S.P.C., all charges were dismissed one week before trial. Defense of Public Officials and Public Figures

Public officials, political figures, and individuals in the public eye face particular risks when allegations of corruption or misconduct surface. Criminal exposure is compounded by media scrutiny that can damage a reputation well before a case reaches a courtroom. The firm provides confidential counsel combined with careful management of media and public relations concerns.

Mr. Withers has represented elected officials, government employees, and law enforcement officers facing criminal investigations and charges. His prosecutorial background — which included the prosecution of a former Congressman for bank fraud — gives him direct insight into how the government investigates and prosecutes public corruption cases. In U.S. v. B.D., a former government employee represented by Mr. Withers was acquitted of bid rigging charges following a federal trial. In J.P. v. The State, the firm secured dismissal of a former police chief’s indictment before the Supreme Court of Georgia, which determined that the indictment did not charge a crime. Prior results do not guarantee a similar outcome.
