Mr. Withers is skillful in federal and state appellate practice and in obtaining the best possible results for his clients on appeal. Mr. Withers handles complex issues on appeal, and develops a strategy to obtain the most beneficial result for his client.

Mr. Withers won a reversal of a contempt citation where the defendant, a young mother of two children, had been sentenced to more than 200 days for contempt for violating a court order.

During a case in which Mr. Withers’ client was sentenced to 21 years in federal prison, Mr. Withers filed a motion before the district court to take advantage of the change in the law under the First Step Act. Though this motion was unsuccessful in the district court, Mr. Withers prevailed upon an appeal and the client was released from custody shortly thereafter.

Mr. Withers also secured a reversal upon appeal, as an indictment against a former Police Chief was dismissed on appeal by the Supreme Court of Georgia on the grounds that the indictment did not charge a crime. General demurrer was granted.

Additionally, Mr. Withers obtained a reversal for a case which was appealed to the Court of Appeals of Georgia on the grounds that jeopardy had attached to a re-indictment of federal criminal charges against the defendant.
